As an EU-based company, the KAEFER Group takes data protection and the new provisions of the German Data Protection Act (DSGVO) very seriously. The data and photos displayed on the Kaefer Blu website are for your information only. Further distribution or use of the contents by third parties is not permitted. We ask for your compliance. This applies particularly to all personal data mentioned there including photographs of any persons (individual or group photos).

2. Collection and storage of personal data as well as method and purpose of their use

a) Data processing when visiting the Kaefer Blu website
When you visit the Kaefer Blu website, the browser on your device automatically sends information to the server on our website. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored for a short time only:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • the browser used and, if applicable, the operating system of your computer as
  • well as the name of your access provider.

The aforesaid data will be processed by Kaefer Blu for the following purposes:

  • Ensuring a smooth connection of the Kaefer Blu website,
  • Ensuring the Kaefer Blu website is user-friendly,
  • Evaluation of system security and stability, as well as
  • For other administrative and statistical purposes.

The legal basis for data processing is Article 6 para. 1 sentence 1 lit. f DSGVO. Kaefer Blu’s legitimate interest follows from the purposes listed above for data collection. Under no circumstances does Kaefer Blu use the data collected for the purpose of drawing conclusions about you personally.

In addition, Kaefer Blu uses cookies and analysis services. You will find more detailed explanations under Sections 4 and 5 of this data protection declaration.

b) Data processing when using contact forms
On the Kaefer Blu website there are various contact forms that you can use to get in touch with us. For example, a contact form for enquiries of any kind, as well as a contact form for online applications as an external business partner for Kaefer Blu (e.g. as subcontractor, supplier).

In the respective contact forms there are the following mandatory fields which must be filled in e.g.: name, e-mail address and other personal business-relevant information. In the contact forms for the online application as an external service provider, you can apply directly to the relevant operational Kaefer Blu company. A valid e-mail address is required so that we know who sent the request and to enable us to respond to it. Additional information may be voluntarily entered by you as a visitor/​inquirer in the contact forms.

Data processing for the purpose of making contact, as described above, is carried out in accordance with Article 6 para. 1 sentence 1 lit. a DSGVO and with your voluntary consent. This is proceeded by the technical option of giving consent by crossing a so-called checkbox (opt-in). By crossing the box you as a visitor give your consent to Kaefer Blu by sending the contact form together with your data.
The personal data collected by Kaefer Blu for the use of the contact forms will be automatically deleted from the website after your request has been processed.

Your enquiry / application as an external business partner are forwarded internally within the KAEFER Group for processing. This will be done on the basis of your aforementioned consent. Your enquiry/application as a subcontractor will be processed and stored in the normal course of business and deleted as required by law.

c) Information reporting system KAEFER Compliance Helpline
The KAEFER website provides information on ways of reporting compliance violations. For this purpose, the electronic whistleblower system https://www.bkms-system.com/kaefercan be used. By using this whistleblower system, the user leaves the KAEFER website. Accordingly, the provider of this website is responsible for data protection and not KAEFER. Information concerning data protection can be found at https://www.bkms-system.com/kaefer.

The KAEFER website also points out that these reports may also be sent to Corporate Compliance & Audit, Marktstraße 2, 28195 Bremen, Germany. Insofar as the reports contain personal data, data processing shall be carried out for the purpose of securing or monitoring pursuant to statutory provisions, regulatory standards and ethical principles on the basis of Art. 6 (1) sentence 1 lit. a DSGVO (your voluntary consent) or Article 6 (1) sentence 1 lit. f DSGVO (legitimate interests of KAEFER). The existence of such reports is based on KAEFER’s legitimate interest in detecting and preventing damage to KAEFER, its employees and customers.

If you send a report to Corporate Compliance & Audit (KAEFER SE & Co KG.), we will take this as your consent to the receipt and processing of your personal data.

Incoming reports will be handled by a small circle of expressly authorised and specially trained employees of the KAEFER Compliance Organisation and will always be dealt with in strict confidence. The employees of the KAEFER Compliance Organisation examine the facts of the case and, if necessary, carry out further, case-related clarifications. When processing a report or in the context of a special investigation, it may be necessary to pass on information to other KAEFER employees or employees of other KAEFER Group companies, e.g. if the information relates to events involving subsidiaries. The latter may also be based in countries outside the European Union or the European Economic Area in which different regulations may exist for the protection of personal data. We always ensure that the relevant data protection regulations are complied with when passing on information.

3. Forwarding of personal data to third parties

Your personal data will not be forwarded to third parties for purposes other than those listed below.

Your personal data will only be passed on to third parties, if:

  • you have given your express consent pursuant to Article 6 para. 1 sentence 1 lit. a DSGVO,
  • the disclosure is necessary pursuant to Article 6 para. 1 sentence 1 f DSGVO in order to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data (legitimate interest),
  • there is a legal obligation for the disclosure pursuant to Article 6 para. 1 sentence 1 lit. c DSGVO, as well as this being legally permissible and required under Article 6 para. 1 sentence 1 lit. b DSGVO for the processing of contractual relationships with you.

4. Data processing with the use of cookies

Kaefer Blu uses so-called cookies on its website. Cookies are small files which your browser automatically creates and which are stored on your device (laptop, tablet, smartphone, etc.) when you visit the Kaefer Blu website. Cookies do no damage to your end device, do not contain viruses, Trojans or any other harmful software.

Information is stored in the cookie, which arise in each case in connection with the specifically used end-device. However, this does not mean that Kaefer Blu immediately becomes aware of your identity.

The use of cookies serves on the one hand to make the use of our websites more pleasant for you. Kaefer Blu uses so-called session cookies to recognise that you have already visited individual pages of the website. These are automatically deleted after leaving the Kaefer Blu website.

In addition, Kaefer Blu also uses temporary cookies that are stored on your terminal for a specified period of time to optimise user-friendliness. 5. Data processing with analyse-tools

The tracking measures listed below and used by Kaefer Blu is carried out based on Article 6 para. 1 sentence 1 f DSGVO. In this respect, Kaefer Blu has legitimate interests at its side within the meaning of this provision.

Google Analytics
Kaefer Blu uses Google Analytics for the purpose of demand-oriented design and ongoing optimisation of the KAEFER website. KAEFER has a legitimate interest in such use within the meaning of Article 6 para. 1 sentence 1, lit. f DSGVO. Google Analytics is a web analysis service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, on the one hand anonymised user profiles are created and on the other hand cookies (see Section 4) are used.

The information generated by the cookies about your use of this website is transferred to a Google server in the USA and stored there. The following data is affected:

  • browser type/version,
  • operating system used,
  • referrer URL (the previously visited page),
  • host name of the accessing computer (IP address),
  • time of the server request.

The information is used to evaluate the use of the KAEFER website, to compile reports on the website activities and to provide further services associated with the use of the website and the internet for the purpose of market research and demand-oriented design of those internet pages. KAEFER uses plug-ins and links on the KAEFER website on the basis of Article 6 para. 1 sentence 1 f DSGVO in order to make the KAEFER Group better known. The underlying advertising purpose is regarded as a legitimate interest within the meaning of the DSGVO. The responsibility for data protection-compliant operation is to be guaranteed by the provider in question. These plug-ins and links are integrated by Kaefer Blu by means of the so-called two-click method in order to protect visitors to Kaefer Blu’s website in the best way possible.

Kaefer blu has active profiles on LinkedIn and Facebook.
Kaefer Blu use social media to keep you updated about us and our activities, and for recruitment purposes. If you choose to follow or like our social profiles, your personal data (such as your name and the fact that you are interested in Kaefer Blu) can be visible to people browsing your personal social profiles. If you interact with our social profiles or content posted by us, we may receive personal data about you, such as your (user) name, profile photo, hometown, email address, phone number, gender (depending on your own privacy settings). Examples of interactions with our profiles include commenting on our posts, creating visitor posts or sending us a personal message.

We may use our followers as targeted audiences for marketing activities in social media.

c) Gravity Forms
Kaefer Blu utilize the Gravity Forms plugin to collect and store personal information that has been submitted to us. By itself, Gravity Forms does not set any cookies on the front-end of the site. It does set a cookie on the entry detail page in the admin when an admin views the entry and checks the show empty fields checkbox, that cookie is named gf_display_empty_fields. d) Newsletter
You can sign up for newsletters from us. For this we need to save your e-mail address. The information is not shared with others and is not used for other purposes. If you enter an e-mail address to subscribe to newsletters, but do not respond to the confirmation message we send, your e-mail will be stored for a period in our system. Then we do not send newsletters, and such unconfirmed addresses are deleted from time to time. You can request to stop this service at any time. When you receive a newsletter, you can also unsubscribe yourself using the unsubscribe link. We delete personal information when you no longer want to receive messages from us.

7. Your rights

You have the following rights:

  • To request information about your personal data processed by Kaefer Blu pursuant to Article 15 DSGVO. In particular, you may request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their specifications.
  • To immediately request the amendment of incorrect or incomplete personal data stored by Kaefer Blu pursuant to Article 16 DSGVO.
  • To request the deletion of your personal data stored by Kaefer Blu pursuant to Article 17 DSGVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.
  • To request, pursuant to Article 18 DSGVO, the restriction of the processing of your personal data, if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and Kaefer Blu no longer needs the data, but you need it to assert, exercise or defend legal claims or you have filed an objection to the processing pursuant to Article 21 DSGVO.
  • To request, pursuant to Article 20 DSGVO, that the personal data you have provided to Kaefer Blu is received in a structured, current and machine-readable format or to transfer the data to another responsible person;
  • In accordance with Article 7 para. 3 DSGVO, you may revoke your consent to KAEFER at any time. Consequently, Kaefer Blu is no longer allowed to continue processing data based on this consent in the future.
  • In accordance with Article 77 DSGVO you can complain to a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at KAEFER’s headquarters.

8. Right of recourse

If your personal data is processed based on legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO, you have the right to object to the processing of your personal data in accordance with Art. 21 DSGVO, if there are reasons for this which arise from your particular situation or if the objection is directed against direct advertising. In case of the latter, you have a general right of recourse, which KAEFER will implement without specifying a particular situation.

9. Data security

During your visit to the Kaefer Blu website, Kaefer Blu uses the SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser. Usually this is a 256-bit encryption. If your browser does not support a 256-bit encryption, Kaefer Blu uses a 128-bit v3 technology instead. Whether a single page of Kaefer Blu’s website is transmitted in encrypted form is determined by the closed display of the key or lock symbol in the lower status bar of your browser.

In addition, Kaefer Blu also uses appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or total loss, destruction or unauthorised access by third parties.
